Fresh Start Pro Screening does not make employment, licensing, housing, legal, medical, or governmental decisions on behalf of any client. Any decisions based on screening results are the sole responsibility of the requesting employer, agency, organization, or individual.

No Legal or Medical Advice

The information, reports, and services provided by Fresh Start Pro Screening do not constitute legal, medical, or professional advice. Clients should consult with qualified legal counsel, healthcare providers, or other professionals regarding decisions related to screening results.

Background Checks

Background check information is obtained from sources believed to be reliable; however, Fresh Start Pro Screening does not guarantee the completeness, accuracy, or timeliness of information received from courts, government agencies, employers, educational institutions, or other third-party sources.

Drug and Alcohol Testing

Fresh Start Pro Screening collects specimens in accordance with applicable procedures. Laboratory analysis, Medical Review Officer (MRO) determinations, and final test results are performed by qualified laboratories and licensed professionals. Fresh Start Pro Screening is not responsible for laboratory processing delays, reporting delays, or errors by third-party providers.

DNA Testing

DNA testing services are conducted through accredited laboratories. Fresh Start Pro Screening acts as an authorized specimen collection provider and chain-of-custody facilitator. Laboratory findings are the responsibility of the testing laboratory.

Fingerprinting

Fingerprint collection services are provided for submission to authorized agencies. Fresh Start Pro Screening cannot guarantee acceptance, processing times, or outcomes by state or federal agencies.

Fair Credit Reporting Act (FCRA)

Where applicable, background screening services are provided in compliance with the Fair Credit Reporting Act (FCRA). Employers and other requesting parties are responsible for obtaining all required disclosures, authorizations, and following applicable adverse action procedures.

Limitation of Liability

To the fullest extent permitted by law, Fresh Start Pro Screening shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use of its services, reports, testing results, or reliance upon information provided by third-party sources.

Service Availability

Fresh Start Pro Screening reserves the right to refuse service, discontinue services, or modify service offerings at any time in accordance with applicable laws and regulations.

Tennessee Law

This Disclaimer shall be governed by and construed in accordance with the laws of the State of Tennessee. Any disputes arising from the use of Fresh Start Pro Screening's services shall be subject to the jurisdiction of the appropriate courts located in Tennessee.
